What You Should Know​

Penalties for Drug Distribution Based on Drug Classes

Class A Penalties

First Offense:
 • Jail not more than 2 1/2 years
 • OR state prison not more than 10 years
 • OR fine of between $1,000 and $10,000
 • OR imprisonment in jail or state prison AND a fine.

Second or Subsequent Offense:
 • State prison not less than 5 years or more than 15 years 
 • AND fine of not less than $2,500 or more than $25,000

Class B Penalties

First Offense:
 • Jail not more than 2 1/2 years
 • OR state prison not more than 10 years
 • OR a fine not less than $1,000 and not more than $10,000
 • OR imprisonment in jail or state prison AND a fine.

Second or Subsequent Offense:
 • State prison for not less than 3 years or more than 10 years 
 • AND a fine of not less than $2,500 or more than $25,000

Class C Penalties

First Offense:
 • Jail or house of correction for not more than 2 1/2 years
 • OR in state prison for not more than 5 years
 • OR a fine of not less than $500 or more than $5,000
 • OR imprisonment in jail or state prison AND a fine.

Second or Subsequent Offense:
 • State prison for not less than 2 1/2 years but not more than 10 years 
 • OR jail not less than 2 years or more than 2 1/2 years
 • OR a fine of not less than $1,000 or more than $10,000
 • OR imprisonment in jail or state prison AND a fine.

Class D Penalties

First Offense:
 • Jail not more than 2 years
 • OR fine of not less than $500 and not more than $5,000
 • OR imprisonment in jail AND a fine.

Second or Subsequent Offense:
 • Jail not less than 1 year or more than 1 1/2 years 
 • OR fine of between $1,000 and $10,000
 • OR imprisonment in jail AND a fine.
